Home Office Entitlement?
The Federal Ministry of Labor and Social Affairs issued the Sars-2-Cov occupational health and safety regulation on Jan. 21, 2021. The regulation has already been the subject of lively discussion under the catchphrase “Home Office Entitlement”. This is because in the case of office work or comparable activities, the employer must offer employees the opportunity to carry out these activities in their homes “if there are no compelling operational reasons to the contrary.” The employer decides whether such reasons exist. The discussion about the “Home Office Obligation” should not obscure the fact that these are occupational health and safety regulations. Employers are therefore well advised to update their risk assessments. However, there is no reason for increased concern about employee claims.
